Terms & Conditions

Company: The Grand Living (“TGL”)
Registered Address: 10 Desmond Street, Kamerville, Sandton.
Applies to: All sales, quotations, estimates, invoices, orders, deliveries, collections, and related services supplied
by TGL. By accepting a quotation, placing an order, making payment, or otherwise instructing TGL to supply goods or services, the Client agrees to be bound by these Terms and Conditions, subject always to any rights the Client may have under applicable South African law. If any provision of these Terms and Conditions is inconsistent with applicable law, that law will prevail to the extent of the inconsistency
Definitions
• TGL, we, us, or our means The Grand Living.
• Client, you, or your means the customer purchasing goods or services from TGL.
• Goods means furniture, décor items, lighting, mirrors, or other products manufactured, supplied, or sold by TGL.
• Bespoke Goods means custom-made, made-to-order, personalised, or specially finished goods produced to the Client’s specifications or selected variations.
• Quotation, Estimate, or Invoice means a written document issued by TGL setting out pricing, specifications, quantities, or scope.
• CMT means cut, make and trim work performed using fabric, leather, or other materials supplied by the Client.
Quotations & Orders
Unless otherwise stated in writing, quotations are valid for 14 days from the date of issue.
• Reserved stock items will be released after 48 hours if payment has not been received.
• All stock is subject to availability at the time the order is confirmed.
• Any change requested after quotation approval or order confirmation may require re-quoting and may affect
price and lead times.
• Bespoke Goods may be subject to a development fee where non-standard sizes, finishes, specifications, or designs are requested.
• Bespoke Goods are produced to the Client’s specifications and may not be cancelled, returned, or refunded except where required by applicable law.
• Natural stone, engineered stone, fabric, leather, Dmber, and other raw materials remain subject to supplier availability.
• The Client must inform TGL in advance of any delivery or installation access constraints, including staircases,
lifts, corridors, passageways, door dimensions, parking restrictions, or hoisting requirements.
• TGL may require a site visit at an additional charge to assess hoisting, special handling, or third-party installation requirements.
• All delivery quotas remain subject to the final confirmed delivery destinations and access conditions.
Pricing & Payment Terms
Unless expressly stated otherwise in writing, all prices exclude delivery, hoisting, installation, long-distance protective wrapping, boxing, crating, specialist packaging, screws, nails, light bulbs, and similar accessories or services.
• Unless expressly stated otherwise in writing, prices are quoted inclusive of VAT only where VAT is specifically
shown on the quotation or invoice. If VAT is chargeable and not separately identified due to an administrative error, TGL reserves the right to correct the invoice to reflect the applicable VAT treatment required by law.
• Orders under R100,000 require 100% upfront payment.
• Orders above R100,000 require a 75% deposit before manufacturing or procurement begins, unless otherwise
agreed in writing.
• The balance of the purchase price, together with all delivery, storage, packaging, handling, and related charges,
must be paid in full before any goods are released, collected, dispatched, or delivered, unless TGL agrees otherwise in writing.
• Payment must be reflected in TGL’s bank account before goods are ordered, manufactured, released, or delivered.
• The Client must use the full name and relevant document or quotation reference as the payment reference to assist with payment allocation.
• TGL may suspend manufacturing, dispatch, delivery, or handover if payment is overdue or if proof of payment does not match cleared funds.
Manufacturing & Lead Times
Standard lead times are typically 6 to 12 weeks, depending on the goods ordered and manufacturing capacity.
• Bespoke Goods may require manufacturing lead times of 12 to 16 weeks or longer depending on complexity, sourcing, and production requirements.
• Newly developed or first-time designs may require lead times of 6 to 8 months from receipt of all required approvals and payments.
• Any lead time provided by TGL is an estimate only and relates primarily to manufacturing. Estimated lead times may be affected by quality control requirements, workshop scheduling, public holidays, supplier delays, shortages, freight delays, raw material availability, fabric or leather availability, or other circumstances beyond
TGL’s reasonable control.
• Manufacturing will not commence until TGL has received: cleared payment as required; all final design
approvals; final measurements; confirmed choices for wood, stone, steel, leather, and fabric; approved CMT materials where applicable; and final delivery or access instructions where relevant.
• Manufacturing of the frames of all upholstered items will only start once the fabric has been received.
• Where the Client supplies CMT fabric or other materials not forming part of TGL’s standard supplier ranges, TGL
will require a 1m X 1m sample for workshop approval before manufacturing commences. If the material is
rejected on reasonable technical grounds, the Client must provide a suitable alternative before production can
proceed.
Delivery & Collection
TGL deliveries are ordinarily performed by third-party couriers or logistics providers and are billed separately unless expressly included in writing.
• Delivery charges are based on distance, item size, weight estimates, complexity, access conditions, manpower requirements, waiting time, and any specialist handling required.
• Deliveries within a 150 km radius of the Kramerville showroom are quoted based on the information available at the time of quotation. Deliveries outside that radius may require separate courier quotations and
revised charges.
• Larger, heavier, fragile, or difficult-to-access items may incur additional manpower and/or hoisting surcharges.
• Weekend deliveries may incur additional after-hours surcharges.
• Delivery quotations are valid for 14 days from the date quoted unless otherwise stated.
• Unless otherwise specified in writing, delivery includes one layer of protective wrapping only. Boxing, crating, and specialist export or long-distance packaging are excluded and may be quoted separately.
• Boxing or crating is strongly recommended for long-distance or international shipment, especially for items incorporating stone, glass, mirror, ceramic, or other fragile materials.
• Unless otherwise agreed in writing, delivery excludes installation, wall mounting, electrical connection, plumbing connection, removal of existing items, and removal of wrapping or crating materials.
• Delivery scheduling is ordinarily Monday to Friday between 9:00 and 17:00. Specific times may be requested but cannot be guaranteed.
• The Client must ensure that an authorised receiver is present on the agreed delivery date and that the site is accessible and ready to receive the goods.
• The Client or authorised receiver should inspect the external packaging and visible condition of the goods on delivery and note any visible damage or shortages on the delivery documentation at the time of receipt.
• If a delivery cannot be completed because the receiver is unavailable, access is not possible, or instructions previously supplied by the Client are incorrect or incomplete, the Client may be charged an additional delivery,
storage, or redelivery fee.
• For collections, the Client must allow at least 48 hours for preparation unless TGL confirms otherwise. Collection times are subject to TGL’s operating hours and stock readiness.
• The Client is advised to take care when unwrapping goods and not to use sharp tools in a manner that could damage the product.
Storage
The first 5 days of storage are free from the date on which TGL notifies the Client that the full order is ready for collection or delivery.
• Thereafter, storage charges may be levied from R100 per day or such other reasonable amount as TGL may notify, depending on volume, handling requirements, and insurance considerations.
• TGL may retain goods until all outstanding storage, delivery, and related charges have been paid in full.
Product Warranty
Nothing in these Terms and Conditions limits, excludes, or waives any rights that a consumer may have under applicable South African law, including the Consumer Protection Act 68 of 2008 where it applies. In particular, where the Consumer Protection Act applies, consumers may have the benefit of an implied warranty of quality
and related remedies in respect of defective, unsafe, or unsuitable goods within 6 (six) months after delivery, subject to the requirements and limitations of that Act. In addition to any non-excludable rights under applicable law, TGL offers a voluntary warranty against defects in workmanship on furniture manufactured by TGL for a period of 12 (twelve) months from the date of delivery or
collection, subject to the terms below.
• The voluntary workmanship warranty applies only to defects in workmanship existing at the time of delivery or collection and manifesting during the warranty period.
• The warranty does not apply to unfair wear and tear, misuse, abuse, neglect, accidental damage, improper cleaning, environmental exposure, acts of pets, insects, or moisture, unauthorised alterations or repairs, failure to follow care instructions, or use in a commercial or high-traffic environment unless TGL has expressly agreed otherwise in writing.
• Where goods are assembled by the Client or a third party, the warranty applies only if assembly was carried out in accordance with TGL’s or the supplier’s specifications.
• Natural materials, including Dmber, leather, stone, marble, and similar materials, may contain natural markings,
tonal variation, veining, grain variation, movement, or texture differences. These natural characteristics do not
constitute defects.
• Fabric, leather, and other upholstery coverings are subject to normal wear, fading, stretching, creasing, dye-lot
variation, and environmental effects, and are not warranted against ordinary wear and tear.
• The Client must retain proof of purchase and provide the original invoice or other acceptable proof of purchase when making a claim.
• TGL may inspect or assess any goods returned or reported under warranty before confirming the appropriate remedy.
• Where a valid claim arises under TGL’s voluntary warranty, TGL may, subject to applicable law, repair the relevant defect, replace the affected component or product with the same or a reasonably comparable item, or
provide a refund or credit where repair or replacement is not reasonably possible.
• Unless otherwise agreed in writing, TGL may charge a reasonable handling fee and any direct collection or delivery costs actually incurred, to the extent permitted by law.
Returns & Refunds
All goods supplied by TGL are subject to quality control processes; however, the Client must notify TGL within 7
days after becoming aware of any defect, damage, shortage, or incorrect supply.
• Except where applicable law provides otherwise, TGL is not obliged to accept returns based solely on a change of mind, incorrect selection by the Client, or where goods were ordered to the Client’s specifications.
• Bespoke Goods, custom finishes, custom upholstery selections, made-to-order goods, and specially procured goods may not be cancelled, returned, or refunded except where required by applicable law.
• Reseller or non-bespoke goods approved for return by TGL must be returned unused, in their original condition, and where reasonably applicable in their original packaging.
• Any handling fee, collection charge, redelivery cost, inspection fee, or reasonable charge for return packaging will be disclosed where applicable and may be deducted or charged only to the extent permitted by law. Where goods are defective and applicable law gives the consumer a right to a repair, replacement, or refund,
TGL will honour those rights in accordance with that law.
• Where a return or cancellation is accepted by TGL, TGL may charge a reasonable handling fee and any direct collection or delivery costs actually incurred, to the extent permitted by law.
• If the transaction qualifies as an electronic transaction under the Electronic Communications and Transactions Act 25 of 2002, or as a direct marketing transaction under the Consumer Protection Act, any cancellation rights
will apply only to the extent provided by the relevant legislation and subject to any applicable exclusions.
• Services already rendered, delivery already performed, installation already completed, and non-recoverable third-party costs may be charged where permitted by law.
International Orders
Clients arranging shipment outside South Africa are responsible for appointing and paying their chosen freight
forwarder, shipper, or logistics provider unless TGL agrees otherwise in writing.
• The Client is responsible for export compliance requirements, import duDes, taxes, customs clearance, destination charges, and any country-specific restrictions unless otherwise agreed in writing.
• VAT may be zero-rated or excluded only where;
– Payment is made from a non-South African Bank Account, and BOP can be provided
– Export documentation is provided after goods leave South Africa in the form of a SAD500 document.
Limitations of Liability
To the fullest extent permitted by applicable law, TGL will not be liable for delays, additional costs, or loss arising from incorrect or incomplete information supplied by the Client, including incorrect measurements, access details, or delivery instructions.
• To the fullest extent permitted by applicable law, TGL will not be liable for delays caused by supplier shortages, courier delays, force majeure events, customs issues, strikes, load-shedding, or other circumstances beyond
TGL’s reasonable control.
• Product images, samples, showroom displays, website content, and point-of-sale materials are provided as
guides only. Due to screen settings, batch variation, natural material characteristics, hand-finishing, and manufacturing tolerances, colours, textures, grain, veining, and dimensions may vary reasonably from samples or images.
• Unless otherwise agreed in writing, workshop-manufactured or handcrafted items may have reasonable dimensional tolerances. Any tolerance specifically agreed for a product will prevail.
• Nothing in these Terms excludes liability that cannot lawfully be excluded or limited under applicable law.
Ownership & Risk
Ownership in the goods remains with TGL until TGL has received payment in full of all amounts due in respect of the relevant goods and any related charges.
• Risk in the goods passes to the Client on collection by the Client or the Client’s agent, or on delivery to the delivery address nominated by the Client, subject always to any rights the Client may have under applicable
law. Force Majeure
TGL will not be liable for any delay or failure in performance caused by events beyond its reasonable control,
including natural disasters, fire, flood, epidemic, pandemic, civil unrest, labour disruption, transport interruption,
utility failure, load-shedding, supplier default, material shortages, import or export restrictions, or courier
disruption. In such circumstances, TGL will be enDtled to a reasonable extension of time to perform.
Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Subject to any mandatory rights a consumer may have under applicable law, any dispute arising from or in connection with these Terms and Conditions shall be subject to the jurisdiction of the South African courts.

While TGL aims to ensure the accuracy of its quotations, invoices, catalogues, website content, and marketing
materials, typographical, clerical, pricing, or administrative errors may occur. Any such error may be corrected by TGL, acting reasonably, provided that no correction will override any rights the Client may have under applicable law. By making payment or confirming an order, the Client confirms that the information supplied to TGL is, to the best of the Client’s knowledge, complete and accurate, and that the Client has read and accepted these Terms and Conditions.
